Terms of Service

Introduction

The Greenwave Future Services, referred to as "Greenwave Future" or "Services," are provided by GREENWAVE FUTURE TECH LIMITED, also known as "We," "Our," or "Greenwave Future," to you, the "User" or "Users."

Your Acceptance

1. By using the Greenwave Future mobile app, website, or any other product or service provided by Greenwave Future, collectively referred to as the "Services," you confirm your agreement to both these terms and conditions, known as the "Terms of Service," and our Privacy Policy.
2. You should periodically review the most current version of these Terms of Service, although we will strive to notify you of any significant changes. Greenwave Future reserves the right to modify or revise these Terms of Service at any time. The changes and revisions will become effective seven days after they are posted. No portion of these Terms of Service is intended to grant any rights to third parties.
3. If our services are utilized for a business purpose, that business agrees to these terms. The business agrees to indemnify and hold harmless Greenwave Future, its employees, agents, and officers, from any action, claim, or lawsuit arising from or related to the use of the Services or the breach of these terms, including any costs or liabilities resulting from damages, claims, losses, suits, judgments, attorneys' fees, and litigation expenses.

Ability to Accept Terms of Service

You confirm that you are at least 13 years old and capable of entering into the terms, conditions, obligations, affirmations, representations, and warranties outlined in these Terms of Service, and that you will adhere to and comply with these Terms of Service.

Service

1. Every user of Greenwave Future Services, including those who contribute Content to the Service, is bound by these Terms of Service. The term "Content" encompasses scripts, graphics, photos, sounds, music, videos, text, software, interactive features, audiovisual combinations, and any other content accessible through or contributed to the Service. The "Service" includes all components of any Greenwave Future product, such as services and software provided by the Greenwave Future app, Greenwave Future website, Share, Subscribe, RSS, and Embed features, Dashboard, and other applications.
2. The Service may include links to third-party websites not owned by GREENWAVE FUTURE TECH LIMITED. GREENWAVE FUTURE TECH LIMITED is not responsible for and has no control over the privacy policies, practices, or content of these third-party websites. Additionally, GREENWAVE FUTURE TECH LIMITED will not censor or edit any content from third-party sites. By using the Service, you release GREENWAVE FUTURE TECH LIMITED from any liabilities arising from the use of third-party websites.

Greenwave Future User Accounts

1. To access certain features of Greenwave Future Services, you must register a Greenwave Future user account. Unauthorized use of another user’s account is strictly prohibited. You must provide complete and accurate information when registering a user account. You are solely responsible for all activities conducted in your account; therefore, it is crucial to keep your account password secure at all times. In the event of unauthorized use or a security breach of your account, you should immediately contact and notify Greenwave Future.
2. In addition to Greenwave Future not being responsible for any losses resulting from unauthorized use of your account, you may be held liable for any losses Greenwave Future or others incur due to such unauthorized use.

General Use of the Service

Greenwave Future grants you permission to access and use its Services as outlined in these Terms of Service, provided that:

1. You are not permitted to modify or alter any part of the Service.
2. When using the Embed feature on your website, you are prohibited from modifying, altering, adding to, or disabling any part or functionality of the Embed feature, including but not limited to links back to the Greenwave Future website.

Feedback and Implementation

1. You may not always agree with the content on Greenwave Future and may come across content that you find unpleasant or disagreeable. In most cases, you can choose to ignore it and refrain from sharing it with others. However, if you encounter content that violates the content guidelines, please contact us via the Feedback section on our app, and we will address it promptly.
2. If you discover that someone's behavior violates our regulations, such as infringing on copyright, please inform us. The Greenwave Future staff will review your report and assess whether it violates the regulations or is inappropriate. If we determine that there is an issue, we will notify the account owner and inform them of the steps required to resolve it. In extreme cases, we may delete the content directly or suspend the account without prior notice.
3. Please understand that everyone's views may differ. What you find unacceptable may not be considered unacceptable by others, nor does it necessarily violate our regulations. We strive to maintain a fair and open approach to handling issues. After carefully reviewing your report, we hope that you can further communicate with us about your opinion.

Greenwave Future Programs

1. Ad Revenue Program:
   a. When users visit our website, we use direct advertisers or third-party advertising companies to serve ads. Except for your name, address, email address, or telephone number, these companies may use information about your visits to our website and other websites to provide advertisements about goods and services that may interest you.
2. Third-Party Advertisements and Links:
   The Service may feature advertisements delivered by third parties (such as ad networks). Your interactions, correspondence, or business dealings with any third-party advertisers found on or through the Service are solely between you and such advertiser. Greenwave Future does not endorse, and is not responsible or liable for, any content, goods, or services available from these advertisers. You agree that Greenwave Future shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.
3. Virtual Currency and Purchases:
   a. Viewing content on Greenwave Future platforms may give you the opportunity to visit an in-app or online store. By accessing these stores, you may use an online "currency" to license various virtual goods, such as episodes of a story. You may also be awarded virtual Coins or other currencies to use for virtual "shopping." These currencies do not have real-world value but can be exchanged for designated items. Some items have expiration dates, while others do not. Items obtained using virtual currencies will remain in your account until the item's expiration date, your account's expiration or termination date, or until the platform is discontinued. Regardless of any consideration offered or paid in exchange for the virtual currency, you do not own or have rights to the items obtained with the virtual currency. Greenwave Future is not liable for the loss of your items from your account but will make reasonable efforts to replace such items under certain circumstances at our discretion. We have no responsibility to reimburse you for any item or experience lost due to your violations of this and any other rules, policies, notices, and/or agreements. Prices and availability of items are subject to change without prior notice. You agree that you cannot and have no right to sell or transfer any of the items, virtual currency, or any other content or information included in any Greenwave Future platform, in whole or in part, to any third party in exchange for anything of value, including real money. Additionally, you agree that any virtual currency you receive on any Greenwave Future platforms is not real currency or any type of real-world financial instrument and is not redeemable for any sum of money from Greenwave Future at any time.

Termination

1. Users who violate these Terms of Service, interfere with the operation of any program, or engage in conduct that is detrimental or unfair to Greenwave Future, the program, or any other users (as determined solely by Greenwave Future) may be subject to suspension or cancellation of their user account(s) and their ability to submit requests for payment.
2. Greenwave Future will terminate a user's access to the Service if the user is identified as a repeat infringer under appropriate circumstances.
3. Greenwave Future reserves the right to determine whether Content violates these Terms of Service for reasons other than copyright infringement, such as but not limited to pornography, obscenity, or excessive length. GREENWAVE FUTURE TECH LIMITED may, at any time and without prior notice, in its sole discretion, remove such Content and/or terminate a user's account for submitting material that violates these Terms of Service.

Copyright Violations

If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information in writing via email with the subject line "Copyright" to support@greenwave-future.com (see 17 U.S.C. 512(c)(3) for further details):

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
3. Identification of the material that is claimed to be infringing or the subject of infringing activity, which is to be removed or access to which is to be disabled, along with information sufficient to allow the service provider to locate the material;
4. Information sufficient to allow the service provider to contact you, such as an address, telephone number, and, if available, an email address;
5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

By failing to comply with all of the requirements of this section, you acknowledge that your DMCA notice may not be valid.

Copyright Notice

All content, features, and functionality on the Greenwave Future Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, data compilations, and design, are the exclusive property of GREENWAVE FUTURE TECH LIMITED or its licensors and are protected by applicable copyright laws of Hong Kong and international copyright treaties.

• You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from Greenwave Future without prior written permission from GREENWAVE FUTURE TECH LIMITED.
• All rights not expressly granted in these Terms of Service are reserved by GREENWAVE FUTURE TECH LIMITED.

Warranties and Disclaimers

Greenwave Future does not make specific promises about the Service beyond those expressed in these terms or in additional terms; for example, Greenwave Future does not make any commitments about the content within the Service, the specific functions of the Service, or their reliability, availability, or ability to meet your needs. The Service is provided by Greenwave Future "AS IS."

Some jurisdictions provide for certain warranties, such as the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we exclude all warranties.

Limitation of Liability

1. The Service will be governed, construed, and interpreted under the laws of the Hong Kong Special Administrative Region. Members are bound by these Terms of Service and by the decisions of Greenwave Future, which are final. Greenwave Future reserves the right to discontinue or suspend user accounts and any benefits if viruses, bugs, unauthorized human intervention, or other causes beyond our control affect the administration, security, or proper handling of the benefits, or if Greenwave Future Media otherwise becomes unable to run the program as planned, as determined in its sole discretion. In the event of bankruptcy, Greenwave Future reserves the right to deny all benefits and obligations that it may have.
2. Greenwave Future will not be responsible for lost profits, revenues, or data/financial losses, or for indirect, special, consequential, exemplary, or punitive damages when permitted by law.
3. To the extent permitted by law, the total liability of Greenwave Future for any claim under these terms, including any implied warranties, is limited to the amount you paid us to use the Service.
4. In all cases, Greenwave Future will not be liable for any losses or damages that are not reasonably foreseeable.
5. Any further agreements between you and Greenwave Future supersede these Terms of Service in case of conflicts or inconsistencies.

Refund Policy

1. Eligibility for Refunds
   Refunds may be granted under the following circumstances:
   • The purchased subscription or credits were not activated or delivered due to a technical failure on our platform.
   • You were charged for a subscription renewal after you had canceled it before the billing date.
2. Non-Refundable Situations
   We generally do not offer refunds in the following cases:
   • Successfully delivered or accessed digital comics, credits, or subscription services.
   • Subscription renewals canceled after the billing date.
   • Situations where the purchase has been used, consumed, or accessed.
3. Requesting a Refund
   • Refund requests must be submitted within 7 calendar days of the original transaction.
   • Please provide your account email, User ID, transaction details, and a brief description of the issue.
   • Requests should be sent to support@greenwave-future.com (or through our in-app support form).
   • Once validated, refunds will be processed via the original payment method within 10–15 business days.
4. Legal Rights
   Nothing in this Refund Policy affects your statutory rights under the laws of Hong Kong, including but not limited to the Sale of Goods Ordinance (Cap.26) and the Supply of Services (Implied Terms) Ordinance (Cap.457). If local law provides greater protection than this policy, such rights will prevail.
